The Court of Appeal in Abuja has nullified the judgment of the Federal High Court that ordered the deregistration of the African Democratic Congress (ADC), Accord Party, and three other political parties.
In its judgment delivered on Tuesday, the appellate court ruled that the Forum of Former Legislators, which initiated the suit seeking the parties’ deregistration, lacked the legal standing (locus standi) to file the case.
The court held that the lower court ought not to have entertained the matter, having been brought by a party without the legal right to institute the action.
Consequently, the Court of Appeal declared the Federal High Court’s judgment, delivered by Justice Peter Odo Lifu, null and void, setting it aside in its entirety.
In the unambiguous judgment delivered by the Court of Appeal panel led by Justice Abba Bello, a penalty of N1 million was awarded against the former legislators that filed the case.
